An open source legal breakthrough

jammag writes "Open source advocate Bruce Perens writes in Datamation about a major court victory for open source: 'An appeals court has erased most of the doubt around Open Source licensing, permanently, in a decision that was extremely favorable toward projects like GNU, Creative Commons, Wikipedia, and Linux.' The case, Jacobsen v. Katzer, revolved around free software coded by Bob Jacobsen that Katzer used in a proprietary application and then patented. When Katzer started sending invoices to Jacobsen (for what was essentially Jacobsen's own work), Jacobsen took the case to court and scored a victory that — for the first time — lays down a legal foundation for the protection of open source developers. The case hasn't generated as many headlines as it should."

mathoda writes "Investigative reporter Bob Woodward states that America has developed secret capabilities 'to locate, target and kill key individuals in groups such as al-Qaeda in Iraq, the Sunni insurgency and renegade Shia militias, or so-called special groups. The operations incorporated some of the most highly classified techniques and information in the US government.' The LA Times now reports, 'As part of an escalating offensive against extremist targets in Pakistan, the United States is deploying Predator aircraft equipped with sophisticated new surveillance systems that were instrumental in crippling the insurgency in Iraq, according to US military and intelligence officials.' angelheaded tips a Wired story about the resignation of Bob Dykes, CEO of net eavesdropping firm NebuAd. NebuAd has encountered financial troubles lately as the privacy controversy surrounding the company's tracking methods has driven communications companies away. Over in the UK, Phorm responded to the NebuAd news by affirming that it is making progress with its advertising methods. From The Register: "In response to the outcry over our revealing its two secret trials, BT said in April it would re-engineer the planned deployment so traffic to and from customers who do not want their web use profiled for marketing purposes would not come into contact with the Phorm system. The original blueprint meant that a opt-out cookie would tell the technology to simply ignore refuseniks' browsing as it passed through. It's thought the change has proved tricky. Phorm did not immediately respond to a request for comment on the alleged technical problems, but [BT's chief press officer Adam Liversage] said: 'We have been working on some things with Phorm.'"

A man nicknamed "Humble Bob" won $2,500 at the inaugural Skyline Chili Spaghetti eat-off by stuffing over 11 pounds of chili into his belly. The feat took Bob around 10 minutes, beating the favored Joey Chestnut, who won this year's July 4 hot dog eating contest at Coney Island. It's estimated that it will take 4-5 days before anyone can safely stand next to Bob without special breathing apparatus.

Consumerist reports an Associated Press release that Steve Warshak, 42, was found guilty of 93 counts of conspiracy, fraud and money laundering. His 75-year-old mother, who has cancer, was found guilty of conspiracy and other charges, and was sentenced to 2-years, but is free pending appeal. US District Judge Arthur Spiegel, in Cincinnati, OH, denied Mr. Warshak's request to remain free pending appeal, but gave him 30 days to wrap up his affairs and report to prison. Besides Enzyte, Washak's company, Berkeley Premium Nutraceuticals, who also distributes products to boost energy, manage weight, reduce memory loss and aid sleep, will be allowed to stay in business — but must forfeit $500 million. Among their most egregious offenses was a requirement of a Notarized statement from a doctor certifying that they had a small penis. Amazingly, remarkably few customers availed themselves of the refund offer. Unfortunately, it looks like the commercials will still be able to continue...

New details for starcraft 2's zerg

Blizzard had a playable demo of StarCraft 2 running at Leipzig, and Kotaku's Michael McWhertor had a chance to sit down and spend some time playing the Zerg. The Zerg weren't available in previous demos; the Protoss and Terran campaigns were showcased earlier. GameSpy took the opportunity to interview two Blizzard employees about what people can expect from the game. Gameplay footage is also available which shows a Terran vs. Zerg battle. Blizzard PR rep Bob Colayco had this to say: "One thing that's new, as you go through the campaign... you know, normally in RTS games how they start you off with a couple of units and then it's like, 'Okay, two missions later we're going to give you tanks...' One of the things we're looking at doing with StarCraft II's campaign is putting the choice more in the players' hands. So maybe you like dealing more with infantry? You can purchase those upgrades and make your marines and other infantry stronger. Or else you'll save up the credits you get from the missions to get tanks sooner than you normally could."

Bob Hearn writes "I was in attendance at the US Go Congress match yesterday where history was made: the go program MoGo, running on an 800-core supercomputer, beat 8-dan professional go player Myungwan Kim in a 9-stone handicap game. Most in the audience were shocked at the computer's performance; it was naturally assumed that the computer would be slaughtered, as usual. Go is often seen as the last bastion of human superiority over computers in the domain of board games. Ian Lamont writes "Bob Sutor, IBM's vice president of open source and standards, used his keynote appearance at LinuxWorld to complain about the lack of industry-specific open source apps. Despite some encouraging signs in the educational field with Sakai, Sutor said that he was 'tired of waiting' for specialized applications to appear in other sectors, adding that the proliferation of different licenses — and changing legal requirements for using the same software over time — is holding some businesses back from using open source applications."
